Samuel Juarez Jr., the 34-year-old Brownwood man who was initially charged with intoxication manslaughter in the Dec. 17 death of 8-year-old Daylan Franklin, has been indicted for murder.
    The February session of the Brown County Grand Jury returned an indictment that alleges two counts of murder, alleging the use of a deadly weapon — Juarez’s car — in both counts, 35th District Court records state.
     Juarez was driving a 1995 Ford Crown Victoria that struck Daylan in the 1600 block of Sixth Street in Brownwood, police said earlier. Juarez fled the scene and was apprehended a short time later. He remains in the Brown County Jail, and his bonds total $300,000, jail records state.
    Count 1 of the indictment alleges Juarez committed the felony offense of driving while intoxicated after being convicted twice previously of DWI, and that he “committed or attempted to commit an act clearly dangerous to human life” by driving his car into Daylan.
    Count 2 repeats the allegation that Juarez “committed or attempted to commit” an act dangerous to human life by operating a car under the influence of alcohol or another substance, failing to maintain a single lane of travel, operating a car while distracted and failing to maintain a proper lookout.
