Brown County prosecutors dismissed the online impersonation charge Monday against Lanny Bush, who is charged with capital murder in the September 2012 death of his former girlfriend, Michele Reiter.
Bush, 53, appeared briefly in 35th District Court, where prosecutors announced they are dismissing the online persecution charge. Bush is still charged with online impersonation in Tom Green County.
Bush had been accused in an indictment of posting Facebook messages under the name Rocky Switzer “with the intent to harm Michele Reiter.”
Bush still aces an identical charge in Tom Green County.
Prosecutors in Brown and Coleman counties have said little about the case since a Coleman County grand jury returned the capital murder indictment in August.
Bush's court-appointed attorney, Perry Sims, said there not yet any court settings in Coleman County for Bush.
Coleman County District Attorney Heath Hemphill said earlier he anticipates that members of Brown County District Attorney Micheal Murray's staff will assist in the prosecution of Bush.
Reiter, an employee of The Home Depot in Brownwood, was last seen the evening of Sept. 10, 2012. Searchers found her body in a shallow grave in Coleman County on Sept. 24
